Fee Schedule:
Mediator time is charged at the hourly rate of $125.00 per party for two party cases. The mediator is entitled to compensation for all time spent on the case, including preparation time and review of information submitted to the mediator before mediation, telephone conferences, attendance at the mediation conference, separate and private conferences with the mediator, as well as conferences in which all parties are present, follow-up, preparation of the mediator’s report to the Court or administrative agency, and travel time if applicable. There is a one (1) hour minimum charge for cases reserved for one half day and a two (2) hour minimum charge for cases reserved for a full day.
Reservation Policy:
Your mediator in this case is an experienced full-time professional. The mediator reserves time exclusively for your case and will not accept other engagements for the time you have reserved. Due to the difficulty of scheduling a new case when there is a cancellation, rescheduling or settlement, coupled with the time and expenses already incurred in scheduling and preparing for the conference and the positive effect a scheduled conference can have in settlement negotiations, the following policies have been adopted:
In the event this case is cancelled, rescheduled or settled the day of the conference or within three (3) business days prior to the day of the scheduled conference, there will be a fee charge of one (1) hour times the hourly rate per party for cases reserved for one half day or less and two (2) hours times the hourly rate per party for cases reserved for a full day.
If the case is court ordered, a mediation conference will only be rescheduled if both parties agree in writing.
Mr. Greene cannot and will not allocate responsibility for a cancellation. Unless the parties in the case agree on who should pay the mediator’s fee and advise the mediator, the parties, through their attorneys (if applicable), shall be billed equally.
Billing:
Fees will be billed either when the case is cancelled or at the conclusion of the mediation conference. Unless directed otherwise, the fee will be divided equally among the parties. Invoices are sent shortly after the mediation concludes and is due upon receipt. Attorneys, while it may be subject to reimbursement by your clients, or forwarded to them for payment, the engagement is solely and directly with you and has been accepted by Mr. Greene in reliance on that. Attorneys representing parties in this case are expected to advance the fees billed and ensure that the mediator is paid in a timely manner.
By accepting the terms of engagement outlined in this Confirmation of Mediation Conference and Disclosure Statement sent upon confirmation of the scheduled mediation, you agree to pay Greene Mediation Services 1.5% per month on all balances outstanding for more than thirty days. If your mediator is required to use the services of an attorney to collect any balance, it is understood that you will pay the attorney's fees and costs.
